    • 1). Consult a qualified bankruptcy attorney. Look for an attorney who is a member of the National Association of Consumer Bankruptcy Attorneys and who has experience filing consumer bankruptcy cases. He or she will be able to help you make the right decisions during the process.

    • 2). Explain your financial situation clearly and truthfully. Your attorney will ask you to complete a financial questionnaire and list all of your debts. Do not omit any information and be completely honest with your attorney at all times.

    • 3). Provide all information accurately and on a timely basis. You'll be asked to list all of your creditors, down to phone numbers, addresses, and account numbers. Do this clearly and as accurately as possible. Also provide the information within the time frame your attorney requests.

    • 4). Follow your attorney's instructions regarding counseling, both before and after you file. You'll have to complete financial management and counseling courses before and after you file. If you fail to complete the required courses, your case could get dismissed or thrown out.

    • 5). Attend your 341 Hearing as instructed. You will have to attend a hearing, along with your attorney, called a 341 or "Meeting of the Creditors." Your attorney, as well as the bankruptcy court, will give you specific instructions on attending this hearing. If you miss the hearing, your case can be dismissed or thrown out.
