How to Return a Used Car Bought in Texas
- 1). Give written notification to the manufacturer (not the car dealer) of the vehicle, giving the specific details of the problems you are having with the car, the dates you took the vehicle to be repaired (including the name, address and telephone number of the places to which you took the vehicle), and the dates on which the vehicle has been inoperable. You should send the letter certified mail, return receipt requested and include copies of any repair bills you have.
- 2). Wait 30 days for the manufacturer to respond to your letter. If the manufacturer does not respond or if you are not satisfied with the response, then file a complaint with the Texas Department of Motor Vehicles.
- 3). Give the manufacturer an opportunity to inspect and/or repair the vehicle if the manufacturer makes such a request.
- 4). Complete the complaint form. Be sure to give your name, address, and telephone numbers, as well as the place where you purchased the car and the date you purchased it. Then give specific details on the problems you are having with the car, including when the problems first started, and the dates of any times when you could not drive the car because of the problems. List the dates and the information on any and all repair shops you have taken the car to. You should also explain any efforts you have taken to resolve the problems including writing the manufacturer. Include copies of any repair bills and correspondence regarding the car and its problems.
- 5). Send the completed complaint form and the required filing fee to the Austin address printed on the form. Wait for someone to contact you from the Texas Department of Motor Vehicles regarding when your hearing will be held and any other information you need regarding the complaint process. Be aware that efforts will be made to resolve your complaint without a hearing.
- 6). Wait 30 to 45 days after your hearing for a written decision from the administrative law judge. The judge will state in the decision what remedy you are entitled to, including whether you can return the used car to the car dealer or manufacturer.
- 7). File a lawsuit in the district court of Travis County within 30 days of receiving the judge's decision if you are not satisfied with the ruling.
