Federal Noise Regulations
- Federal regulation 16 USC 1a-1 gives the National Park Service directions to do a study concerning what the minimum altitude for flights over national parks should be to provide a peaceful atmosphere for patrons.
- The EPA was granted control of noise regulation in 42 USC. This regulation gives the EPA the distinct power to waive noise regulations for the purpose of research.
- In 42 USC 4910, strict penalties are provided for violating federal noise regulations. On a first offense of violating the regulations, the violator can be fined up to $25,000 and sentenced to a year in prison. A second offense can result in doubled penalties. The same regulation also provides for up to $10,000 in civil penalties per day.
- Code 49 USC places the Federal Aviation Administration in charge of ensuring compliance of federal noise regulations in regards to airports, aircraft and sonic booms.
- Civil suits are allowable under 42 USC 4911, even if the offending party is the United States government or any other governmental agency. This regulation stipulates that the suit must be against the EPA or FAA, depending on which agency is charged with ensuring compliance for the offending party.
